ORDINANCE NO. 1998-1


AN ORDINANCE OF THE TOWNSHIP OF LATIMORE REGULATING THE USE AND ENJOYMENT BY THE PUBLIC OF ANY PARK OR RECREATION GROUNDS OWNED AND OPERATED BY THE TOWNSHIP AND PRESCRIBING RULES FOR THE USE OF SUCH AREAS BY THE PUBLIC.

     Be it Enacted and Ordained by the Supervisors of Latimore Township, Adams County, Pennsylvania under and by virtue of the authority conferred upon them by Article XXII of the Second Class Township Code as follows:

ARTICLE I

Definitions


As used in this Ordinance, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:

A. PARK OR PARKS - Unless specifically limited, shall be deemed to include all parks, playgrounds, recreation areas, courts, recreation structures and facilities, and also entrances and approaches thereto, and all other land or property or structures, now or hereafter owned, leased or acquired by the Township of Latimore for park or recreational purposes.

B. PERSON - any natural person, corporation, organization of persons, company, association or partnership.

C. PARK BOARD OF LATIMORE TOWNSHIP - as created by Ordinance #1997-1, known as the "recreation and park board".

ARTICLE II

Rules and Regulations


The following rules and regulations are applicable to all Latimore Township parks.

A. The park shall be opened from sunrise to sunset throughout the year unless otherwise posted. Times for special events must be approved by the recreation and park board.

B. No person shall annoy or harm any animals or birds in a park, nor disturb any fish or water fowl in any streams, pools or ponds, nor remove or carry away any birds' nests or eggs, nor disturb the general natural environment. No person shall injure, deface, climb, mutilate, pull up, remove, destroy any vegetation in the park, whether tree, brush, shrub, vine, fern, flower or fruit.

C. No person shall enter or leave the park except by the entrances or exits provided for such purposes. Private property of owners adjacent to the park shall not be entered upon.

D. The general use of pavilions, ballfields, equipment or special facilities shall be on a first come, first serve basis, unless previously scheduled through the recreation and park board.

E. The designated use of ballfields or other facilities by organized groups shall be scheduled through the recreation and park board.

F. The use of the park for any of the following purposes is prohibited unless specifically authorized by the recreation and park board:
     1. Fireworks
     2. Musical or theatrical entertainment

G. All police departments with jurisdiction in Latimore Township shall have the power to enforce the regulations herein set forth and shall exercise supervision over persons and property in all parks.

H. The following are prohibited:
     1. Distribution or consumption of any alcoholic or intoxicating beverages, or any controlled substances (unless prescribed by a licensed medical doctor for use by the possessor of it);
     2. Gambling or solicitation not authorized by the Township;
     3. Possession of any type of firearm;
     4. Annoyance of others by disorderly conduct, indecent or obscene language, loitering, threatening or dangerous actions;
     5. Damaging, defacing, destroying or removing park property, buildings, equipment, signs, structures or other materials;
     6. Discarding of trash, garbage, or other litter not generated on the premises. Trash, garbage or litter generated on the premises must be discarded into containers provided for that purpose;
     7. Distribution or advertisements, placards, or notices (except as authorized by the recreation and park board or Board of Supervisors) or posting of the same;
     8. Pets, except when properly controlled and kept on a leash not exceeding six feet in length. All pet waste must be cleaned up by the pet's owners. All animals are prohibited from the baseball, softball, and soccer playing fields;
     9. Operating, stopping or parking any vehicle except on designated areas. There shall be no parking permitted on any grassy area or on the roads;
     10. Fires, except in facilities provided for such purpose;
     11. Snowmobiles, all-terrain vehicles, go-carts, mini-bikes, motorcycles, scooter bikes or like vehicles;
     12. Flying model airplanes or the like;
     13. Climbing of any of the fences within the park is prohibited; and
     14. Use of bows and arrows, javelins, discus or similar athletic equipment dangerous in character.

ARTICLE III

Authority to Close Areas


A. The park and facilities which become hazardous for public use due to weather, water, fire or unforeseeable conditions may be closed upon recommendation of the recreation and park board and/or Chief of Police at the discretion of the Board of Supervisors.

ARTICLE IV

Penalties


The provisions of this Ordinance shall be enforced by an action brought before a District Justice in the same manner provided for the enforcement of summary offenses under the Pennsylvania Rules of Criminal Procedure. Any person guilty of violating the provisions of this Ordinance, upon conviction in the proceedings before the District Justice, shall be sentenced to a fine of not more than $450.00, plus the costs of prosecution and in default of payment of such fines and costs, be sentenced to undergo imprisonment for a period not to exceed thirty days.

AN ORDINANCE TO CREATE A RECREATION AND PARK BOARD
FOR THE TOWNSHIP OF LATIMORE

ORDINANCE #1997- 1



     The Board of Supervisors of the Township of Latimore, in the County of Adams, and the Commonwealth of Pennsylvania, hereby ordains:

     Section 1. That there is hereby created a recreation and park board known as the Park Board of Latimore Township.

     Section 2. That the board shall be composed of seven members, to be appointed by the Township Supervisors, with the power to provide and conduct recreation and cultural activities and maintain public recreation areas, facilities, and centers. The board members shall serve for terms of five years and until their successors are appointed, except that the members first appointed shall be so appointed that the term of one member shall expire annually thereafter. Vacancies shall be filled in the same manner as original appointments and for the unexpired term. Members shall serve without pay.

     Section 3. That the recreation and park board shall appoint from its membership a chairman and such other officers as it may deem necessary for the orderly procedure of its business, and may adopt by-laws, rules, and regulations covering its procedure not inconsistent with the provisions of the State laws. The recreation and park board shall, from time to time, make rules governing the operation and conduct of the recreational facilities operated by the board upon aproval of the board of supervisors of the Township. The board shall hold regular meetings at such time and place as it may designate.

     Section 4. That the recreation and park board shall maintain, operate, and supervise the public parks, playfields, and all outdoor and indoor recreation areas owned or controlled by Latimore Township.

     Section 5. That the recreation and park board may accept any grant, gift, bequest, or donation of services, equipment, or money from any individual or group, to be used as specified by the donor, or by the terms of acceptance. The recreation and park board shall have no authority to enter into any contract or incur any obligation binding upon Latimore Township, other than current obligations or contracts to be fully executed within the then current fiscal year, and all within the budget appropriations made by the governing body of Latimore Township.

     Section 6. That funds appropriated by the governing body of Latimore Township, and budgeted to the recreation board, shall be disbursed by the fiscal disbursing officer of Latimore Township. Funds received by the recreation and park board from sources other than budget appropriations shall be deposited by the Township Treasurer, to the credit and for the use of the said board, and disbursed as the above budget funds are disbursed, except that funds received by gift, bequest, or otherwise shall be disbursed in accordance with the terms of the acceptance thereof. All expenditures over five hundred ($500.00) dollars must be pre-approved by the Latimore Township Board of Supervisors.

     Section 7. That the recreation and park board shall submit an annual report and such other reports as needed to the governing body at such times as may be designated or requested by the governing body. The fiscal year of said recreation and park board shall conform to that of Latimore Township.

     Section 8. That all resolutions and ordinances of the Township of Latimore in conflict herewith are hereby repealed.

     Section 9. That this ordinance shall be in force and effect 30 days after its passage.

     Duly Enacted and Ordained this 13th day of October, 1997, by the Board of Supervisors of the Township of Latimore, Adams County, Pennsylvania, in lawful sessions duly assembled.
