September 15, 1998

The Latimore Township Zoning Hearing Board met on Wednesday, September 15, 1998 at the municipal building. Board members present included Larry Dost, Kenneth Buohl and David Lockard. Attorney Guy P. Beneventano presided as solicitor. Chairperson Larry Dost called the hearing to order at 8:05 PM EST. Minutes of the last meeting were presented to Chairman Larry Dost by Ken Buohl, recording secretary. Larry presented the minutes to the meeting attendees and approved as read. All attendees were sworn in by Chairman Larry Dost.

This first meting is being held to hear the application #072198 with regards to Ms. Patricia I. Linebaugh requesting a variance under section 908 A, 1,2,3,4 and 5 of the Latimore Township Zoning Ordinance, to build a garage which will encroach into a side yard.

Mr. William Albright, as husband of Patricia Linebaugh and Audrey Woloskia as attorney for the Linebaughs presented their application for variance to the board. Mr. Albright testified the purpose and requested location of the two-car garage and how he was concerned about the look of the garage if it was attached to the schoolhouse dwelling they own. Larry Dost defined the requirements for the position of the garage as outlined in the zoning ordinances. Audrey Woloskia questioned several ordinance provisions. Larry Dost explained the ordinance as it pertained to the variance they requested with Guy Beneventano adding additional clarification. Ken Buohl asked several questions concerning adjacent property right of ways and alternate structure styles. He also asked Patricia if she had purchased the property with future plans to build a garage on it. She answered they did and they did not question if they could legally build it. Larry offered additional size and location options without acceptance by Mr. Albright. Larry called for a motion. Ken Buohl made the motion to deny the variance considering present plans for setback do not meet the minimum 20 feet and the proposed size change to a one car garage was not acceptable. Seconded by David Lockard. The board voted three to zero to deny the variance. Larry Dost asked Patricia Linebaugh if she would agree to wave the provisions of the ordinance that requires notice of the board's decision be issued in writing. Patricia agreed to waive the written notification.

The second hearing is being held to hear the application #061398-1 continuance from the August 26, 1998 meeting with regards to Robert H. Conley requesting a supplemental use under section 432.B.4 and section 615 of the Latimore Township Zoning Ordinance which allows "Junk Yard" as a supplemental use within the "I-C" district.

Due to Mr. Conley not being present, Larry Dost placed on record his request for Joanna Zepp to write a letter to Mr. Conley to request a continuance for his hearing. Also placed into evidence was a letter from Attorney Walton V. Davis where he rendered an opinion about the JunkYard Ordinance used in conjunction with the Zoning ordinance.

Dave Lockard asked to adjourn the meeting at 9:16 PM EST with a second by Ken Buohl after agreeing there is no old business or additional new business at this time.
