Regular Meeting 6:00 P.M.

May 11, 2009

 

Present:  Chairman Daniel Worley, Vice-Chairman Larry Dost, Supervisor Elwood “Woody” Myers, Solicitor Guy Beneventano, Township Engineer John Shambaugh, Secretary Valena Garlin and visitors listed on the attendance sheet.

 

Chairman Worley called the meeting to order at 6:00 P.M. and led everyone present in the Pledge of Allegiance to the Flag.

 

Chairman Worley made a motion 1) to approve the Minutes from the April 13, 2009 meeting, 2) to approve the Treasurer's Report of April 20, 2009 and 3) to ratify all checks written during that timeframe.  The motion was seconded by Woody and carried unanimously.

 

Dan welcomed those in attendance, then reviewed the procedures concerning Public Comment, particularly for the benefit of several new faces.

PUBLIC COMMENT in reference to agenda items only.
A representative for James and Marlene Arndt asked that their subdivision be added to the Agenda (Planning Commission).


POLICE REPORT
Chief Michael Weigand submitted his report via Officer Todd Dunlap for the period April 13, 2009 – May 7, 2009.  There were 147 calls for service, 227 duty man-hours logged and 4,376 miles patrolled.  There were 40 traffic citations issued, 15 warnings, two (2) non-traffic citations and one (1) D.U.I. enforcement.

 

The next Crime Watch Meeting is Thursday, May 28, 2009 at 7:00 P.M. at the Township Building.

 

The Safety Tip of the Month is for motorists to be on heightened awareness for kids outside since school will be letting out soon.

 

Dan asked about the ceremony in Gettysburg for fallen Officer Michael C. Weigand, Jr.  Officer Forney reported that a Police Memorial Service honoring Mike had been held Friday, May 8, 2009 at the Gettysburg Cemetery and his name has been put on a Police Memorial Plaque there. 

 

Officer Dunlap continued that Chief Weigand was currently in Washington, D.C. where Mike, Jr.’s name will be placed on the National Police League wall, Panel #53.  He also noted that a public Candlelight Vigil in D.C. is scheduled for Wednesday, May 13, 2009 and a Memorial Service at the Capitol honoring police officers killed in the line of duty will be held Friday, May 15, 2009.

 

COMMITTEE REPORTS
Engineer's Report:
  Engineer John Shambaugh reported that letters had been written to FEMA and DCED referencing the new flood maps.  Several dates have been proposed for a meeting with the residents of Lake Meade; no response has yet been received.

Road Report:  Woody reported that the Road Crew has been doing patch work, cut brush and performed general maintenance.  Chairman Worley noted the challenges presented by harsh weather conditions and outlined detailed repair plans to fix and protect the roads.

Park Report:  Woody reported that the playground equipment was dedicated on Saturday, May 2, 2009, completing Phase I.  A display of pictures that chronicled the park’s development was available for viewing.  Still planned is Phase II which includes a walking trail and split-rail fence.

 

SOLICITOR'S REPORT
Solicitor Guy Beneventano presented a Supplement to the Right to Know Policy with regard to administrative matters and email communication.  After review by the Supervisors and clarification of attorney/client privilege, Dan made a motion to adopt the Supplement.  Larry Dost seconded and the motion carried unanimously.

 

Solicitor Beneventano also presented Resolution 2009-1 under the Right to Know Policy.  By adopting the Resolution, the Board of Supervisors pledges publicly to follow the Local Records Manual published by the State Museum Commission and adhere to the Disposition Schedule for Public Records.  Specifically, the Schedule delineates what records to keep, how long to keep them and the proper procedure for disposing of them when appropriate.  Larry made a motion, seconded by Woody, to adopt Resolution 2009-1.  All agreed and the motion carried.

 

PLANNING COMMISSION:  subdivisions/modules/land developments.

1.   Michael and Deborah Myers Subdivision Plan

  1. Dan made a motion to approve a waiver of the Preliminary Plan.  Larry seconded the motion and it carried unanimously.
  2. Dan then made a motion to approve the Final Subdivision Plan conditional to all fees being paid.  Larry seconded the motion.  All agreed to conditional approval and the motion passed.

 

2.    James E. and Marleen Arndt Subdivision:

Upon written request on the letterhead of John R. Williams, Chairman Worley made a motion, seconded by Woody Myers, to withdraw the James E. and Marleen Arndt Subdivision with the Right of Resubmission if the property is not sold in its entirety.  All agreed and the motion carried.  The Solicitor recommended that a copy of the letter be made part of the Minutes for the record.

 

OLD BUSINESS

NEW BUSINESS

Revised Memorandum of Understanding (MOU) for E&S Program, NPDES Program and Floodplain Monitoring Program:

Solicitor Beneventano indicated that the Adams County Conservation District has prepared a proposed Memorandum of Understanding which has been sent to all county municipalities with a request for approval.  Correspondence dated April 9, 2009 from Russell Ryan, Chief Conservationist, referenced an oral Memorandum of Understanding with Latimore Township approved in 2004 promoting joint cooperation in achieving mutual conservation goals.  The Conservation District has recently agreed to participate in a National Floodplain Monitoring Program; therefore, it has revised the Memorandum to include its involvement with this Monitoring Program and requests adoption by the Board of Supervisors.  The Solicitor noted that both he and the Township Engineer have reviewed the proposal as has Chairman Worley.  After brief discussion and clarification, Dan made a motion to adopt the Revised Memorandum of Understanding (MOU) for E&S Program, NPDES Program and Floodplain Monitoring Program.  The motion was seconded by Woody Myers and carried by unanimous vote.

 

Fireworks Ordinance:

Solicitor Beneventano distributed a Fireworks Ordinance draft he had prepared per the recommendation of Chief Weigand.  Due to advertising requirements and time constraints, he requested 1) that the draft be shared with Chief Weigand upon his return, 2) that feedback be given within the next two (2) weeks and 3) that the Supervisors grant him authority to place notice in the newspaper once the text is approved.  He also distributed copies of a related July 2007 article from the Township Association Magazine and noted the ordinance draft is modeled after the Association’s model. Dan made a motion to grant the Solicitor the authority to advertise the Ordinance upon final approval of the text.  Larry seconded and the motion carried unanimously.

 

Seal Coat Bids:

Woody reported that Hammaker was the only bidder; however, the bid was fractured and required further discussion and review.  Woody made a motion, seconded by Larry, to table the matter until the next meeting.  The motion passed unanimously.

 

BILLS LIST
Upon review, Larry made a motion, seconded by Woody, to accept the Bills List as submitted.  The motion carried unanimously.

PUBLIC COMMENT (2)
Kenneth Buohl, 1570 Fairfield Road, Gettysburg, and Manager of T&P Commercial Printing Division, noted he had submitted a unsolicited bid in March for the printing of the Township Newsletter.  He followed up in April; no one was available.  He recently received the Newsletter; therefore, his purpose was to publicly introduce his company’s services for consideration.  He also questioned the lack of communication, particularly since his bid was approximately $400 less than the cost in 2008.

 

Jason Williams, 139 Plank Road, York Springs, asked why the Agenda was not posted on the window prior to the meeting.

 

Everett Weiser expressed concern about road conditions and offered his assistance in outlet locations.  He also asked the cost to seal coat a road like Bushy School Road.  In addition, he’d like to know if the Township has investments set aside for reserve and, if so, the dollar value and interest rate.

 

SUPERVISORS' COMMENTS
The Supervisors addressed each concern in the order in which it was given.

 

  1. Chairman Worley expressed appreciation to Mr. Buohl for the quote, saying he had reviewed it himself and also had shared it with Woody and Larry. His concerns, however, included 1) that color, which would add significant cost, was not mentioned and 2) the section on postage was inaccurate and not applicable.  He then noted that Mr. Buohl had gotten the Cumberland Printing account for them.  In summary, they have been, and continue to be, pleased with Cumberland’s service, believe they are competitive and see no reason or have any desire to change at this time which is why bids have not been solicited.

 

  1. The Agenda was put in the outside case rather than cluttering up the door.

 

  1. Woody indicated that we know where the outlets are located and expressed confidence in the Road Crew’s ability to handle the job.  Dan thanked Mr. Weiser for his comment and his offer.

 

  1. The Township’s reserve funds are a matter of public information.  Chairman Worley indicated that the balance is between $600,000 and $700,000 with PLGIT.  However, he did not know the interest rate; Mr. Weiser is welcome to submit a Request Slip for that information.  Dan also noted that the recommended Reserve Fund is around $400,000 to cover emergencies, replace equipment and meet unexpected expenses.  He anticipates that 2009 will be an expensive year for road repair and maintenance so that some extra funds beyond $400,000 will be put to good use.

 

EXECUTIVE SESSION

There will be a brief Executive Session following this meeting.

Larry made a motion to adjourn, seconded by Woody.  The motion carried unanimously and the meeting adjourned at 6:57 P.M.
