LATIMORE TOWNSHIP BOARD OF SUPERVISORS
March 12, 2001, Regular Meeting

The duly advertised regular monthly meeting of the Latimore Township Board of Supervisors held at the Township Municipal Building, York Springs, Pennsylvania, was called to order at 6:30 p.m. by Chairman Randall Fishel.

In attendance: Chairman Randall Fishel, Vice-Chairman Charles Dove, Supervisor Daniel Worley, and Solicitor Ron Turo.

A list of all people attending the meeting is on file in the office.

The Pledge of Allegiance was recited.

Auditors Report: Chair Jan Smith read the written Auditors Report of their findings for the year 2000. Charles Dove stated that the Auditors did a fine job.

Stone and Oil Bids: Global Stone was the cheapest of all the stone with the exception of the R-3 Rock for 100 tons. Vulcan Construction was the lowest bid on the R-3 Rock. Regarding the Oil Bids, Hammaker East LTD was the lowest on all three bids. A motion was made by Charles Dove to accept the lowest bids. The motion was seconded by Daniel Worley.

Road Report:
a. Road Master Report - The road crew is keeping up with the roads. A citizen questioned Strayer Road. She stated that it is a small road and that the school bus won't come down the road to pick up the children. She stated that her house is ½ mile one way and 1/3 mile in the other direction and wondered what could be done. Mr. Irvin reported that they plan to widen the road and then the road should be wide enough for the bus to get through. b. Mr. Irvin had no report on purchasing a backhoe for $20,000. Daniel Worley mentioned that Secretary Althoff has a Grant Application to fill out requesting funds for the purchase of a backhoe.

Park Board Report : Sam Giardullo read the Park Board report from the March 7, 2001 meeting. A motion to accept the report was made by Randall Fishel and seconded by Charles Dove. A request was made by the Park Board to pay the cost of the concrete bumpers ($2,040), which was to be a 2000 Park Board expenditure but, due to the billing, was paid in 2001. A motion was made by Randall Fishel to pay this cost out of the General Fund. The motion was seconded by Charles Dove. Daniel Worley opposed the motion. Daniel Worley questioned the amount of the Park Board budget. A motion was made by Daniel Worley to appoint Lynn Schouppaul to the vacancy on the Park Board. The motion died for lack of a second motion. Charles Dove made a motion to appoint Brian Buohl to the Park Board. Randall Fishel seconded the motion. Daniel Worley was opposed. Motion carried.

Public Participation - Joann Kraft asked what happened to the Web site, that it was down. The Worley's will investigate as to what happened. Joann Kraft also asked that more information be put on the Web and the information be updated more frequently. Daniel Worley mentioned the article in the Township News magazine regarding our Web cite. A citizen asked if there would be a Spring Clean-up Day in the Township. Curb side Spring Clean-up is scheduled for Saturday, May 12. Bob Irvin stated that since Waste Management is providing curb side service, not too many residents are bringing items to the recycle shed. Joann Kraft mentioned that would be something to put on the Web. Daniel Worley agreed. Gary Baker commented about Stoney Point Road. Supervisor Fishel suggested that Mr. Baker attend the Police Commission meetings. One citizen had a complaint regarding trees cut down along Old U.S. Route 15. He questioned why some trees were taken down but not others. He further questioned how to enforce the speed on dirt roads. It was mentioned that the roads must be posted before the police can enforce speed and/or accidents. Bob Irvin stated that he has specific regulations by the State for posting signs.

Approval of March 12, 2001, Meeting Minutes - The motion was made by Randall Fishel to accept the Minutes as prepared. The motion was seconded by Charles Dove. Motion carried unanimously.

Engineer's Report/Public Works: As required -
a. General/Bridge Progress Report - Regarding the Bonners Hill Bridge, there was a meeting this week with DEP. The Plans are expected by the end of the month so that bids can go out.
b. Golden Ridge - As requested, I did a review regarding the Highway Occupancy Permit. The information was very limited as to what they were planning to do. It was requested that the Township acknowledge to PennDot that the Township was aware of what was being done at Golden Ridge. It is understood that they are cutting back the bank along U.S. Route 15 in the State Highway right-of-way to provide better visibility to the Travel Center. What they plan to do with the soil they remove is unknown. It was suggested that they may need a mining permit if the material is sold for profit. They would also like to improve the drainage at the intersection of U.S. Route 15 and Ridge Road in the Township right-of-way. That would be a separate permit which would need to be submitted to the Township. The Application submitted to the Engineer was a blank form. The Engineer's recommendation is not to submit a letter of acknowledgment since the details are unknown. Charles Dove made a motion to accept Tom Ladue's report. The motion was seconded by Randall Fishel.
c. 179 Harrisburg Street property - Randall Fishel asked Tom Ladue's opinion on the sewer problem Victor LaRue is having in providing sewer service to this property. This property was to be hooked up to the sewer service but fell into Bankruptcy. The house has now been sold. There is a right-of-way down there that affects three property owners. The York Springs Municipal Authority stated that they do not allow pumps of any kind. A motion was made by Randall Fishel to have the Township engineer look into this matter and report back to us. The motion was seconded by Daniel Worley.

Planning Commission: (Subdivisions/modules/land devs.) - a. Robert Garlin - A motion was made by Randall Fishel to approve the Form B Wavier as presented. Seconded by Daniel Worley. Motion carried unanimously.

Building Permits:
a. #1031 Lerew Brothers - replacement windows
b. #1032 Daniel and Wendy Beiler - new ranch home
c. #1033 Joseph and Lorri French - new two-story home
d. #1034 Gregory and Julie Myers - new two-story home
e. #1035 Wade and Deb Fickel - convert present garage to family room; add new garage
f. #1036 M. Everett and Olive Weiser - siding on home
g. #1037 Marling and Louise Pletcher - shed
h. #1038 Marsha Sajer & Jeff Clymer - new bathhouse next to pool
A motion was made by Randall Fishel to accept the above Building Permits with the exception of #1032. The motion was seconded by Charles Dove. Motion carried unanimously. A second motion was made by Randall Fishel to tentatively accept Building Pemit #1032 on the condition that the Application be signed by the owner. Charles Dove seconded the motion.

Driveway Permit - Randall Fishel made a motion to approve the driveway permit of Daniel and Wendy Beiler. The motion was seconded by Charles Dove. Gary Baker requested a copy of the BOCA fees be posted.

Solicitor's Report: As required -
a. Solicitor Ron Turo reported that the Williams Grove Old Timers were providing him with a lot of information. Solicitor Turo also spoke with Mr. Whisler the same day. A letter is going to be sent to all parties involved requesting additional information. Solicitor Turo is trying to resolve the situation but needs to do further investigating but expects to wrap it up in the next couple of months. b. A motion was made by Randall Fishel to accept the rewording of the Recreation Fee in the Subdivision and Land Development Ordinance. Charles Dove seconded that motion. Motion carried.

Continuing Business: As required -
a. Golden Ridge Travel Center - See above Engineer report.
b. York Springs Fire Department - Randall Fishel made a motion to accept the Fire Protection Appropriation Contract and the Ambulance, Rescue and Life Saving Services Appropriation Contract. The motion was seconded by Charles Dove. Charles Dove made a motion to close a portion of Old U.S. Route 15 on August 11, 2001 until 3:30 p.m. for the Adams County Fireman's Convention Parade. The motion was seconded by Randall Fishel.

c. AYSO - the soccor group stated that they are having trouble getting corporate sponsors when there is no set agreement between the organization and the Township as to how long they will be able to use the fields. Sam Giardullo stated that the Park has no authority to enter into any written agreement with any organization. Randall Fishel made a motion that the Park Board provide the Board of Supervisors with their recommendations regarding the Agreement between the Soccor Organization and the Township. The motion was seconded by Charles Dove. Motion carried unanimously.
d. Zoning Ordinance and Map - Randall Fishel made a motion to set the date of April 2, 2001 at 6:30 p.m. for a public hearing on the Ordinance. Charles Dove seconded that motion. e. Second Board of Supervisors monthly meeting - No motion was made to have a second meeting of the month to discuss building permits or any other business.
f. Transfer of documents to Windows - A motion was made by Charles Dove to have Stu Fink convert the documents once the software has arrived. Seconded by Randall Fishel. Mike McHugh stated that the Federal Government requires all documents be in Word rather than Word Perfect. Dan Worley made a motion to speak with Stu Fink regarding the use of Word vs. Word Perfect. The motion was seconded by Randall Fishel.

New Business: As required -
a. Zoning Hearing Board met on March 6, 2001 for reorganization. Larry Dost was elected Chairman, David Lockard as Vice-Chairman and Kenneth Buohl as Secretary.
b. Salt Contract Participation Agreement - A motion was made by Randall Fishel not to do anything regarding this contract. Bob Irvin is not aware of any other township participating in this program. The motion was seconded by Charles Dove.
c. Occupation tax deadlines - If your occupation status changes, the Township has no cut-off date. Therefore, a motion was made by Randall Fishel to match the date of the School Board. The motion died for the lack of a second. Charles Dove made a motion that all occupation status changes be made prior to March 1. The motion was seconded by Randall Fishel.
d. Donation of computer for Township use - The Board of Supervisors thanked Sam Giardullo for his kind and thoughtful donation.

Bills List - Randall Fishel made a comment that the Township waited a long time for the shelving being provided by Shellehamer Construction. The cost was $350 but he has reduced the price to $300. A motion was made by Randall Fishel to approve the March bills lists. Seconded by Charles Dove. Motion carried unanimously.

Adjournment - A motion was made by Randall Fishel to adjourn the meeting. Seconded by Charles Dove. Motion carried unanimously. Meeting adjourned at 8:07 p.m.
