Regular Meeting
August 11, 2008
Present: Chairman Daniel Worley, Vice-Chairman Larry Dost, Solicitor Guy Beneventano, Engineer John Shambaugh, Secretary Valena Garlin and visitors listed on the attendance sheet. Supervisor Elwood “Woody” Myers was unable to attend.
Chairman Worley called the meeting to order at 6:00 p.m. and led everyone present in the Pledge of Allegiance to the Flag.
Chairman Worley made a motion 1) to approve the Minutes from
the July 14, 2008 meeting, 2) to approve the Treasurer's Report of July 31,
2008 and 3) to ratify all checks written during that timeframe. The
motion was seconded by Larry Dost and carried unanimously.
PUBLIC COMMENT in reference to agenda items only.
There was none.
POLICE REPORT
Chief Michael Weigand reported on the period from July 14-August 10, 2008.
He noted there were 166 calls for service, 203.5 duty man-hours and 3,358
miles patrolled. There were 36 traffic citations issued, eight (8) warnings,
and six (6) non-traffic citations. The Department participated in one DUI
Checkpoint. In addition, Chief Weigand gave details about the following
incidents:
1. a criminal arrest for aggravated assault on a police officer plus propulsion of a missile (rocks) onto a highway
2. three juvenile arrests, and
3. an unresolved incidence of spray painting.
Larry Dost commented on the high number of accidents (7) and also requested an explanation of Duty of Driver in Emergency Area. Chief Weigand confirmed that the accident rate was higher than usual and commented that speed has often been a contributing factor. He then explained the Duty of Driver in Emergency Area and noted that warnings were issued when the law first went into effect, but Officers are now issuing citations.
The next Crime Watch Meeting is Thursday, August 21, 2008 at 7:00 p.m. in the
Township Building.
The Safety Tip of the Month is to be aware that there has been an increase in
thefts which appear to be linked. Residents are encouraged to report any
suspicious activity and especially to report if they are a victim. Also,
school will be starting soon; please be on heightened alert for children
walking and cycling to and from school.
Chief Weigand noted that the DCED Grant Agreement for $10,000 has been received and requires the Supervisors’ signatures. Solicitor Guy Beneventano confirmed that he had reviewed the agreement and advised approval. Dan made a motion to approve the DCED Grant Agreement. Larry seconded and the motion carried unanimously.
COMMITTEE REPORTS
Engineer's Report: Engineer John Shambaugh had no report.
Road Report: In Woody’s absence, Dan reported that the Road Crew
has tarred and chipped all the roads on the list. The County Line road is
tentatively scheduled for treatment as a paid service. Attention will be given
next to building up the bases on dirt roads.
Park Report: Dan reported that all cement has been poured for the playground equipment. The material for surfacing has been ordered and will be applied as soon as it is received. Park Day, traditionally held in September, has been postponed this year.
SOLICITOR'S REPORT
Solicitor Guy Beneventano reported that, as directed by the Supervisors and
requested by the County Recorder of Deeds, he prepared and advertised the local
Realty Transfer Tax Ordinance authorizing the PA Dept. of Revenue in certain
circumstances to collect delinquent realty transfer taxes. It also fixes the
Township’s portion of the tax at 0.5%. He presented a copy to the Supervisors
at which time Chairman Worley made a motion to approve the Ordinance as
written. Larry seconded and the motion carried unanimously.
The Public Hearing is scheduled for Wednesday, August 20, 2008 at the York Springs Fire Hall beginning at 6:00 p.m.
PLANNING COMMISSION: subdivisions/modules/land developments
OLD BUSINESS
There was none.
NEW BUSINESS
Salt Bids were opened and are available for review at the Township
Building. Cargill submitted the lowest bid. Chairman Worley made a motion,
seconded by Larry Dost, to award the contract to Cargill. All agreed and the
motion passed by unanimous vote.
BILLS LIST
Upon review, Larry Dost made a motion, seconded by Dan Worley, to accept
the Bills List as submitted. The motion carried unanimously.
PUBLIC COMMENT
Gary Baker, 116 Two Churches Road, East Berlin, expressed concern about
the amount of cut weeds the rain has washed into the gutter on Two Churches
Road. In his opinion this is an eyesore and also presents a traffic hazard.
Chris Bergman, York Springs, commented that he requested copies of the new zoning ordinance and map at the last meeting. He’s not yet received any kind of notification and wondered if they were available for pick-up.
SUPERVISORS' COMMENTS
Chairman Worley made the following comments:
1. The Township has been making a concentrated effort to keep up with mowing along the roads. In fact, Two Churches Road was mown that very day. He noted that the gutter will be checked.
2. The Township has an obligation to have requests available within five (5) days. Accordingly, Mrs. Garlin, Township Secretary, had Mr. Bergman’s documents ready within two (2) days. She then called the number on the sign-in sheet and left a message, documenting the date and time. Both copies (the ordinance and the map) are in the office. Dan then reiterated the Township’s obligation and recommended that residents may want to follow-up themselves if notification has not been received after five (5) days of making a request.
Vice-Chairman Larry Dost had no comment.
Chairman Worley noted there will be an Executive Session immediately following
this meeting.
Larry made a motion to adjourn seconded by Dan. The motion carried unanimously
and the meeting was adjourned at 6:35 p.m.
The next regular meeting is Monday, September 8, 2008 at 6:00 p.m.
