Regular Meeting 6:00 P.M.

April 16, 2009

 

Present:  Chairman Daniel Worley, Vice-Chairman Larry Dost, Supervisor Elwood “Woody” Myers, Secretary Valena Garlin and visitors listed on the attendance sheet.  Solicitor Guy Beneventano and Township Engineer John Shambaugh were unable to attend.

 

Chairman Worley called the meeting to order at 6:00 P.M. and led everyone present in the Pledge of Allegiance to the Flag.

 

Chairman Worley made a motion 1) to approve the Minutes from the March 9, 2009 meeting, 2) to approve the Treasurer's Report of March 31, 2009 and 3) to ratify all checks written during that timeframe.  The motion was seconded by Woody and carried unanimously.

PUBLIC COMMENT in reference to agenda items only.
Gary Baker
, 116 Two Churches Road, East Berlin, indicated he had a road question.  He overheard a conversation between Mr. Myers and Mr. Shambaugh about Comcast Cable on Mr. Myers Road Crew time. Chairman Worley noted this was not an agenda item and it was hearsay.  Regardless, even if it had occurred, it would have taken only a few minutes and wasn’t worth discussing.

 

Mr. Baker continued to argue.  Dan refused to entertain anymore discussion and moved on.


POLICE REPORT
Chief Michael Weigand submitted his report for the period March 9, 2009 – April 12, 2009.  There were 203 calls for service, 360 duty man-hours logged and 4,800 miles patrolled.  There were 73 traffic citations issued, 32 complaints, and three (3) non-traffic citations.  In addition, the Department participated in one D.U.I. Enforcement Road Patrol.

 

The next Crime Watch Meeting is Thursday, April 23, 2009 at 7:00 P.M. at the Township Building.

 

Additional Police Department involvement includes:

  1. There’s been a rash of vehicle break-ins county-wide.  The Township has experienced its first one and a description has been disseminated.
  2. The Department participated in the Drug Awareness Program coordinated by the Adams County District Attorney’s Office and the Adams County Drug Task Force.  The program targeted high school and middle school students; three (3) students were identified as needing assistance and treatment for drug addiction.  Follow-up with the Principal identified three or four additional students who sought help.  A Parents Only Night is planned to educate parents on signs and symptoms of drug and alcohol use/abuse, drug paraphernalia, and available treatment programs.
  3. The Department continues its involvement with the Greater Hanover Drug Task Force.
  4. The Safe Schools Program has undertaken the task of numbering the doorways of the school buildings to assist First Responders in effectively navigating and communicating in the event of an emergency.
  5. The D.A.R.E. program is finished, culminating in a field trip with the D.A.R.E. graduates.

 

Chief Weigand concluded his report by noting that Pennsylvania Law has returned fireworks issues to the jurisdiction of municipalities.  Accordingly, he proposed that a Fireworks Ordinance be adopted so the Police Department has the necessary authorization to maintain control and curb violation.

 

COMMITTEE REPORTS
Engineer's Report:
  Engineer John Shambaugh was unable to attend; there was no report.

Road Report:  Woody reported that the Road Crew had been digging out broken macadam, filling potholes and performing general maintenance.  Dan added a number of observations:

  1. The winter had been extremely harsh (freezing and thawing quickly several times) which has resulted in a lot of road damage.
  2. He listed several roads scheduled for repair and explained the proposed process for doing so.
  3. A Timber Ordinance needs to be reviewed and a permitting process, may be required.

 

Park Report:  Woody reported that the covering for the playground equipment has all been laid down and only the swings need to be installed yet.  Dedication for the playground equipment is scheduled for Saturday, May 2, 2009.

 

SOLICITOR'S REPORT
Solicitor Guy Beneventano was unable to attend; there was no report.

 

PLANNING COMMISSION:  subdivisions/modules/land developments.

No business.

 

OLD BUSINESS

Award Stone Bids

The stone bids are available for inspection and review at the Township Building.  Samples were collected and researched before deciding how to award the bids based on lowest price and best quality.  Dan made a motion, seconded by Larry, to award the bids to Vulcan Construction Materials, Pennsy Supply and Valley Quarries, Inc.  All agreed and the motion carried.  Dan also revisited the question of proper advertising of this and last year’s stone bids.  He noted to let the record show that the advertising in question was done properly and the back-up is available for inspection and review.

 

Workers’ Compensation for York Springs Borough

Dan reviewed that the Township is required by law to contribute to the Workers’ Compensation Fund for the Fire Company.  The Township has received the bill from York Springs for its share or 70%.  After careful and thorough research, the Supervisors are satisfied that 70% is fair.  Dan made a motion to send payment along with requests for 1) a copy of the policy, and 2) a copy of the check to the insurance company for the Township’s records.  Larry seconded and the motion carried unanimously.

 

NEW BUSINESS

Road Bids / Seal Coat

Dan made a motion, seconded by Woody, to advertise for road bids.  He explained that two types of bids would be solicited - “In Place” where the company provides everything but the stone, and “Rental of Equipment.”  The award will be based on what is most cost-effective and advantageous to the Township.  All agreed and the motion carried.

 

Advertise Timber and Fireworks Ordinances

Dan made a motion authorizing the Solicitor to review a Timber and Fireworks Ordinance. Larry seconded and the motion carried unanimously.

 

BILLS LIST
Upon review, Larry made a motion, seconded by Woody, to accept the Bills List as submitted.  The motion carried unanimously.

PUBLIC COMMENT (2)
Bob Lyons, Lyons Survey, requested approval of a subdivision plan on behalf of Alice Huffman.  After thorough inspection and detailed discussion of the papers and plans submitted [including Reading Township Letter of Approvals, Department of Environmental Protection (DEP) Approvals, Adams County’s Comments, and Engineer John Shambaugh’s Comments], Dan made a motion for conditional approval upon all signatures being in place.  Larry seconded, all agreed, and the motion carried.  The Supervisors all signed; the signatures of the Engineer and the Planning Commission are still required.

 

SUPERVISORS' COMMENTS
Chairman Worley had some new thoughts about the concerns Mr. Baker raised about Comcast.  Noting that the cables would cross roads, Dan requested that Woody research the situation.  In addition, he asked Woody to investigate the possibility of free phone and internet service to the Township in conjunction with Comcast cable installation.

 

There will be an Executive Session following this meeting.

Larry made a motion to adjourn, seconded by Woody.  The motion carried unanimously and the meeting was adjourned at 6:37 P.M.
